These general terms and conditions ("GTC") apply to the business relationships between Baumann IT Thurgau, Räuchlisberg 18, 8580 Amriswil (hereinafter referred to as "company") and its customers (hereinafter referred to as "customers"). The company owns and operates the platform www.it-tg.ch and www.it-thurgau.com and provides paid and free services in connection with IT project management, installation of hardware and IT training.
These terms and conditions apply to the above areas as well as the other services that the company provides directly and indirectly to the customer.
The conclusion of the contract comes about through the acceptance of the company's offer regarding the purchase of services by the customer. The contract is also concluded when the customer uses the services offered by the company.
The contractor is obliged to fulfill orders according to expenditure and with his own work organisation (on his own premises).
If, in some cases, the client's operational presence is required, the client will make the relevant operational facilities available after prior agreement. In addition, all necessary tools, information and documents are made available by the client.
The contractor is free both in working hours and in the technical execution and design of the order(s), whereby these must be carried out according to the recognised professional rules.
The contractor is not bound by any specifications regarding the place of work and working hours, but must comply with the project-related time specifications. Both parties are obligated to inform the other party immediately if processing difficulties or unforeseeable delays should occur.

The working time is defined as the duration that Baumann IT Thurgau works for the customer or is available. Regular working hours at Baumann IT are 8 (eight) hours a day, taking public holidays into account. The opening hours of the website and Google are to be considered as "presence time" and not as working hours. Baumann IT Thurgau reserves the right to claim assignments outside of these time zones at special rates.
Baumann IT Thurgau reserves the right to charge for operations at night and outside of the official opening hours at a higher rate. For example in difficult conditions. The maximum rate however is 150 CHF / h.
The travel time counts as working time and can be charged to the customer. The working time therefore starts when leaving from the company's headquarters.
In the case of on-call duty, no distinction is made between being on standby and being deployed. Except for SLAs, only services and assignments rendered are charged. Baumann IT Thurgau reserves the right to charge for these assignments at a higher rate, which is is smaller or equal to 150 CHF / h.
All prices are in Swiss francs (CHF). All prices are exclusive of any applicable value-added tax (VAT) and exclusive of any expenses (lunch, accommodation, etc.).
The billable hours are rounded to the nearest 5 minutes. The company reserves the right to change prices at any time.
